چکیده

Researchers studying innovation increasingly use indicators based on patent citations. However, it is well known that not all citations originate from applicants— patent examiners contribute to citations listed in issued patents—and that this could complicate interpretation of findings in this literature. In 2001 the US Patent and Trademark Office (USPTO) began reporting examiner and applicant citations separately. In this paper, we analyze the prior art citations of all patents granted by the USPTO in 2001–2003. We show that examiner citations account for 63 per cent of all citations on the average patent, and that 40 per cent of patents have all citations added by examiners. We use multivariate regression and analysis of variance to identify the determinants of examiner shares. Examiner shares are highest for non-US applicants and in electronics, communications, and computer-related fields. However, most of the variation is explained by firm-specific variables, with the largest patent applicants having high examiner shares. Moreover, a large number of firms are granted patents that contain no applicant prior art. Taken together, our findings suggest that heterogeneity in firm-level patenting practices, in particular by high-volume applicants, has a strong influence on the data. This suggests that analysis of firm-level differences in patenting strategies is an important topic for future research. JEL Classification Numbers:

Smoothing the lies: The distinctive effects of patent characteristics on examiner and applicant citations

Patent citations added by examiners are often used indicators of technological impact and knowledge flows, despite various critiques. In this study, we analyse the distribution of examiner patent citations according to patent characteristics, to show their limitations. According to our findings, the number of applicant citations included is dependent on the science-base of the technology. Howev...

Does it matter where patent citations come from? Inventor versus examiner citations in European patents

This paper investigates whether the distinction between patent citations added by the inventor or the examiner is relevant for the issue of geographical concentration of knowledge flows (as embodied in citations). The distinction between inventor and examiner citations enables us to work with a more refined citation indicator of knowledge flows. We use information in the search reports of paten...

Deference Overcome: Courts’ Invalidation of Patent Claims as Anticipated by Art Considered by the PTO

¶1 Courts accord varying degrees of deference to administrative decisions. In the context of patent law, an issued patent is entitled to a statutory presumption of validity that places the burden on the challenger to prove by clear and convincing evidence that the patent’s claims are invalid. The presumption of validity is based, at least in part, on the patent examiner’s consideration of refer...

Patent Citations as a Measure of Knowledge Flows: the Influence of Examiner Citations

Analysis of patent citations is a core methodology in the study of knowledge diffusion. However, citations made by patent examiners have not been separately reported, adding unknown noise to the data. We leverage a recent change in the reporting of patent data showing citations added by examiners. The magnitude is high: two-thirds of citations on the average patent are inserted by examiners. Cognitive Distances in Prior Art Search by the Triadic Patent Offices: Empirical Evidence from International Search Reports

Despite large numbers of empirical studies are conducted on examiner patent citations, few have scrutinized the cognitive limitations of officials at patent offices in searching for prior art to add citations during patent prosecution. This research takes advantage of the longitudinal gap between International Search Reports (ISRs) required by the Patent Cooperation Treaty (PCT) and subsequent ...
